By accessing or using any service offered by M/S PM BAROSANI, you (“User”, “Customer”, “you”) agree to comply with and be legally bound by these Terms under applicable Indian laws.

These Terms are designed to ensure transparency, legal compliance, responsible communication practices, and alignment with Meta and telecom operator policies.

2. Definitions

  • “Services” refers to all digital communication, customer engagement, transactional messaging, and related solutions provided by M/S PM BAROSANI.
  • “User” means any individual or entity interacting with our services.
  • “Platform” refers to WhatsApp Official API, RCS channels, website, or associated communication systems.
  • “Message Content” includes any text, media, files, or data transmitted via our services.
  • “Meta” refers to Meta Platforms, Inc., including WhatsApp services.
  • “RCS” refers to Rich Communication Services operated via telecom carriers and Google infrastructure.

3. Acceptance of Terms

By accessing our services, registering, communicating, or interacting through our platforms, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue use immediately.

4. Description of Services

M/S PM BAROSANI provides business communication services, including:

  • Customer support messaging
  • Transactional alerts
  • Promotional communication (where legally permitted)
  • Service notifications
  • Order or service updates
  • Automated chat responses

Services may be delivered via WhatsApp Business API, RCS messaging, SMS fallback, or web-based interfaces.

5. Eligibility

You must:

  • Be at least 18 years old
  • Have legal capacity to enter a binding agreement
  • Use services only for lawful purposes
  • Not be prohibited under Indian law

6. Account Registration

Certain services may require registration. Users agree to:

  • Provide accurate information
  • Maintain confidentiality of credentials
  • Notify us of unauthorized access

We reserve the right to suspend accounts providing false or misleading information.

7. User Responsibilities

Users shall not:

Users must comply with Meta Messaging Policies, Telecom Regulations in India, and TRAI guidelines.

8. Payment & Billing Terms

Where services are paid:

  • Fees must be paid as agreed
  • Late payments may result in suspension
  • Taxes, including GST, may apply
  • Charges may vary based on messaging volume or platform costs

9. Subscription Renewal & Termination

Subscriptions may auto-renew unless terminated. Either party may terminate services with notice. We may suspend services for:

  • Policy violations
  • Legal non-compliance
  • Fraud or misuse

10. Use of WhatsApp Official API & RCS

Users acknowledge that:

  • Messages are subject to Meta and telecom policies
  • Template approval may be required
  • Delivery depends on recipient consent and platform rules
  • We do not control Meta or telecom infrastructure

Non-compliant messaging may lead to account restrictions by Meta or telecom providers.

11. Message Delivery & Compliance Policy

M/S PM BAROSANI ensures:

  • Messaging only to opted-in users
  • Clear opt-out options
  • Respect for Do Not Disturb (DND) regulations
  • No prohibited categories (illegal, adult, gambling, etc.)

Delivery is not guaranteed due to carrier, device, or platform limitations.

12. Intellectual Property Rights

All systems, software, branding, and materials are the property of M/S PM BAROSANI or licensors. Unauthorized use is prohibited.

13. Confidentiality

We maintain confidentiality of business and communication data, subject to legal requirements or platform integrations.

14. Disclaimer of Warranties

Services are provided “as is” without warranties of uninterrupted availability, error-free performance, or guaranteed delivery.

15. Limitation of Liability

M/S PM BAROSANI shall not be liable for indirect, incidental, or consequential damages, including message delays, losses due to platform failures, or third-party disruptions.

16. Indemnification

Users agree to indemnify M/S PM BAROSANI against claims arising from misuse, policy violations, or unlawful messaging.

17. Governing Law (India)

These Terms are governed by the laws of India. Courts in Maharashtra shall have jurisdiction.

18. Changes to Terms

We may update Terms at any time. Continued use indicates acceptance.
